Draft decision on the recognition of the Chambre de l’assurance and public consultation

The Autorité des marchés financiers (AMF) has published the draft decision regarding the recognition of the Chambre de l’assurance in its October 2, 2025 Bulletin. At the same time, it announced the launch of a public consultation on the matter, which will run until December 12, 2025. What is a recognition decision?

Under the Act to amend various provisions mainly in the financial sector (Bill 16), the AMF is mandated to recognize the Chambre de l’assurance as a self-regulatory organization. To do so, it must adopt a recognition decision that outlines the conditions the Chambre must meet to fulfill its mission of protecting the public.

 

Contents of the draft recognition decision

Divided into six appendices, the AMF’s proposed recognition decision for the Chambre covers:

  • Governance of the board of directors and its committees
  • Investigations and disciplinary matters
  • Information sharing and collaboration between the Chambre and the AMF
  • The process for rule changes
  • The Chambre’s obligations regarding communications, finances, and technology management
  • Conditions related to the withdrawal of functions and powers concerning mutual fund representatives and scholarship plan representatives

     

Next steps

Here are the upcoming steps in the process leading to the recognition decision’s implementation:

  1. Public consultation until December 12: Comments must be submitted directly to the AMF. For more details, visit the ongoing consultations page.
  2. Analysis of comments received by the AMF, in collaboration with the Chambre
  3. Publication of the final version of the recognition decision
  4. Implementation of the decision: Scheduled no later than July 4, 2026, under Bill 16
