Confidentiality and Terms of Use

Thank you for visiting the Chambre de la sécurité financière (“Chamber”) website. Please carefully review the Terms of Use (“terms”) before using the site.   

Canada, conditional upon acceptance of the terms below.

By accessing, using and/or downloading documents from the site, you agree, on your own behalf and on behalf of every entity for which you are acting, to accept and abide by these terms.  If you do not agree to comply with these terms, you must not use the site or download or use the contents or documents available on the site or provide personal or confidential information.  These terms apply solely to your access to and use of the site and do not in any way modify the terms of any other agreement in effect between you and the Chamber.

The Chamber may change, suspend, discontinue or terminate any aspect of the site, including the availability of any feature, at any time without notice or liability.  Similarly, the Chamber may also remove, add, modify or otherwise change any content on or from the site, including third-party content.  The Chamber may also impose restrictions regarding specific features and services or limit your access to a part of or the entire site, without notice or liability.

Property rights

Limited license and copyright

Subject to terms and conditions, the Chamber grants you a non-exclusive, non-transferable, limited right to access and display this site and its visible text, graphics and images (“documents) and to view and download said documents solely in relation to the products and services described by the Chamber, for internal use by you or your firm in Canada, pursuant to these terms.

This authorization does not constitute a transfer of ownership of the documents or copies of documents and is subject to the following restrictions:

  • On every copy of the downloaded documents, you must retain the copyright notices or other notices of ownership contained in the documents;  
  • You may not modify the documents in any way, reproduce them or display them publicly, interpret or distribute them or otherwise use them for any public or commercial purpose;
  • You may not transfer the documents to anyone without the Chamber’s written authorization; and
  • You may not print or copy any HTML programming or other software accessible on the site.

You agree to abide by all of the additional restrictions posted on the site, which may be updated from time to time.  The site, including any documents that appear therein, is protected by copyright legislation and treaties.  You agree to respect all copyright legislation when using the site and prevent any unauthorized copying of documents.  Except as expressly provided for in these terms, the Chamber grants you no express or implicit right or license with respect to any Chamber intellectual property right (including official brands, trademarks, copyright or confidential information).

Trademarks

The names of Chamber products, entities and logos may be trademarks (including registered trademarks) belonging to the Chamber or a third party.  The product and entity names and logos may not be copied, imitated or used in whole or in part without the prior written consent of the Chamber or third party involved.

Reserve of rights

The Chamber’s products, services, methods and procedures may be covered by one or more copyrights and other statutory intellectual property and property rights.  The Chamber reserves all rights; your only rights in this respect are the rights described herein.

Software

All software, as well as all documents, images and works that accompany or are generated by the software used or accessible through the site are works that are copyright-protected by the Chamber or its suppliers.  The Chamber grants you a non-exclusive license to use said software for the purposes expressly stipulated on the site.  Except as permitted by law, you may not use said software for any other purpose and may not distribute, sell, decompile, decode, disassemble or otherwise tamper with the software.

Termination

The Chamber may terminate all rights and licenses contained herein by simple notice and, as of then, you must immediately destroy all documents and software.

Exclusion and limitation of liability

The documents, software and information accessible via the site may contain inaccuracies and typographical errors.  The Chamber and its suppliers make no representations and warranties with respect to the documents, software or information accessible via the site nor with respect to the reliability of any advice, opinion, statement or other information displayed on or distributed through this site.  You acknowledge that you rely on it at your own risk.  The Chamber reserves the right, at its own discretion, to correct any error or omission in any part of the site.  The Chamber may make any other change to the site, documents, software and products, services, programs described on the site at any time without notice or liability.

The site, the documents, software and information available via the site are provided “as is” without any express or implicit representation or warranty of any kind whatsoever, and the Chamber and its suppliers hereby exclude any warranties and conditions regarding them, including, but without limiting the generality of the foregoing, any implicit warranties and conditions regarding quality, absence of hidden defect, adaptation to a specific use, title and lack of infringement, as well as conditions arising from all applicable legislation or from the course of business or commercial use.  The Chamber does not guarantee that the site will function in an uninterrupted or error-free manner.

In no case shall the Chamber and its suppliers be liable for any direct, indirect, incidental, punitive, exemplary or other damages whatsoever (including, but without limiting the generality of the foregoing, the loss of profits, savings or income, interruption of activity, loss of information, computer programs or other data on your information processing system) prompted by the use or inability to use this site, its contents or documents available through the site, or any information, software, product or service obtained through the site, or the functions of the site or any connected or related site, regardless of whether the Chamber and its suppliers have been advised of the potential for such damage.

The limitations and exclusions of liability contained herein apply regardless of the form or nature of the action, whether it is based on contractual, tort or strict liability, a warranty, offence, quasi-offence, negligence or other tort, and shall survive any expiry or cancellation of these terms.

User behaviour

You agree not to:

  • Use the site in a way that may damage it, put it out of service, overload or compromise it;  
  • Jeopardize security or otherwise abuse the site or any service, system resource, account, server or network connected to it or sites that are affiliated, connected or accessible through them;  
  • Disrupt others’ use or enjoyment of the site or affiliated or connected sites;
  • Upload, post or otherwise transmit to the site a virus or other harmful, disruptive or destructive computer file or program;
  • Use a robot, spider or other automatic device or manual procedure to control or copy site pages or content;  
  • Use or attempt to use someone else’s account, service or system without the Chamber’s authorization, or create or use a false identity on the site;
  • Transmit chain letters or other unsolicited mass email through the site; and
  • Attempt to gain unauthorized access to the site or parts thereof for which access is restricted.  Moreover, you agree that you are solely liable for all actions and communications made or transmitted on or for your account and you agree to abide by all applicable legislation with respect to your use of the site or your activities on it.  

Links and third-party content

For the sake of convenience, the Chamber may provide on the site links to websites operated by other entities.  If you use such sites, you leave the Chamber’s site.  If you decide to visit a connected site, you do so at your own risk and are responsible for taking all measures to protect yourself from viruses and other damaging factors.  The Chamber makes no representations and warranties regarding connected sites, the information therein, any product or service described therein or other connected sources and does not necessarily endorse them.

The site may, from time to time, contain documents, data or information furnished, posted or offered by third parties.  You agree that the Chamber is in no way liable to you for such third-party documents, data or information.  

Any hyperlink to this site must be approved by the Chamber in writing.  

Confidentiality

Under section 286 of the Act respecting the distribution of financial products and services, R.S.Q. c. D-9.2, the Chamber is subject to the Act respecting access to documents held by public bodies and the protection of personal information, R.S.Q., c. A-2.1.  It must therefore take reasonable steps to ensure the protection of the personal information collected, used, communicated, stored or destroyed.

Use of cookie files and automatic exchange of information

A cookie file is a file that your Internet browser creates on your hard disk, in which the cookies issued by the websites you visit are stored.   The Chamber’s website issues such files as they make it possible to record information on site visitors and their browsing habits, helping the Chamber ensure that the site meets browsers’ needs.   The information the Chamber may thus collect is not used for profiling but solely for statistical purposes and in no way makes it possible to identify users.   With your browser’s options, you can deactivate accepting cookies at any time.

The information gathered by the Chamber’s website server is:

  • Domain name, if any
  • Internet Protocol address (“IP”)
  • Browser and operating system an Internet user uses to access the site
  • Date and time of site access
  • Site pages consulted
  • Internet address from which you accessed the Chamber’s website

Certain types of browser (Internet Explorer, Opera, Firefox, etc.) make it possible to automatically save user names and passwords.  You are strongly recommended to deactivate this option to protect the confidentiality of your transactions on the website.

Transmission of personal information

As per the Act respecting access to documents held by public bodies and the protection of personal information, the Chamber’s website does not collect any personal information without the Internet user’s consent.

When you use the “PDU record” section on the website or online credit card payment function, you voluntarily give the Chamber and its authorized service providers personal information that you enter.   The Chamber has taken reasonable steps to ensure that this portion of the site is secure.   This personal information and information you may voluntarily transmit to the Chamber via email or an electronic form on the website shall solely be used in compliance with applicable legislation.   Inter alia, it will only be used for the purposes for which it was collected, it will be securely stored or destroyed, and will only be transmitted to third parties in the situations permitted by law.

Insofar as an email communication is never completely secure, the Chamber advises against sending it personal information in this manner.   If you do so, rest assured that the Chamber will handle your email using the same measures it uses for physical mail.   Similarly, unless you agree, the Chamber will not answer your questions via email if it involves communicating personal information.

Security of some functionalities

The “PDU record” functionality allows Internet users to securely provide personal information to the Chamber.   It can only be accessed using a user code and password.   Internet users must take the necessary steps to ensure that their identifiers are confidential and, if confidentiality is compromised, they must inform the Chamber to have proper steps taken to prevent fraudulent use of the data.

With respect to the functionalities for making a credit card payment online, the card data are only accessible to the online payment service provider and are kept, encrypted, as long as required to ensure that the transaction has been completed to the parties’ satisfaction.   

Certification and security protocol

The Chamber’s web servers create an SSL connection with your computer.  The connection allows you to communicate with us confidentially and prevents other computers from seeing the operations you are doing, allowing you to deal with us online securely.  The SSL protocol comes with 128-bit encryption security, which means that the sensitive information sent via the Internet during online transactions remain confidential.

HTTPS (the S refers to secured) is a combination of HTTP and SSL. It allows visitors to verify the identity of the site they are accessing through an authentication certificate.  It guarantees the confidentiality and integrity of the data sent by the user and received by the server.  When you see HTTPS at the beginning of the Chamber’s website address, this confirms that you have a secure connection.   

Right of access and correction

As per and subject to the provisions of the Act respecting access to documents held by public bodies and the protection of personal information, you can obtain access to any personal information the Chamber has regarding you.   You may also, subject to the provisions of the act, request that inaccurate, incomplete or equivocal information be rectified or destroyed.   To learn how to submit such requests, click here

International users

This site is controlled, operated and administered by the Chamber in Canada. The Chamber makes no representations or warranties to the effect that the site is appropriate for use outside Canada and access to the site from areas outside Canada is prohibited.  If you access the site outside Canada, you are required to abide by all local legislation.  

User responsibility

Insofar as possible, users must make sure they use the latest version of their browser in order to optimize browsing of the Chamber’s website.

Applicable legislation

These terms are governed by the laws in force in the Province of Québec, Canada.  In the event of a dispute with respect to this site, use of the site or these terms, you accept that the courts of the District of Montréal, Québec, Canada have sole jurisdiction and competence.  

General

These terms constitute the entire agreement between the Chamber and you with respect to the subject herein.  If for any reason a court of competent jurisdiction finds that a provision in these terms is unenforceable or illegal, said provision shall be applied to the greatest extent allowed in order to give effect to the intent of these terms and the other provisions in the terms shall remain in full effect.

Changes and updates

The Chamber has the right, at its own discretion, to add, remove, modify or otherwise change these terms at any time, in whole or in part.  Please check whether the terms have been updated by referring to the date of the last update that appears at the top of this document.  Use of the site and downloading or using site documents following such changes shall be construed as your consent to said changes.
